Delivery & Installation Policy

At Black Forest Trees, we want every delivery and installation to go smoothly for you. Please review the following so we can provide the best possible service.


Service Area

We currently serve Hamilton and surrounding areas in Ontario. If you are unsure whether we deliver to your location, contact us before placing an order and we'll do our best to accommodate you.


Scheduling

Deliveries and installations are scheduled by mutual agreement. A confirmed delivery date is set once your 50% deposit has been received. We will contact you to confirm timing in advance. If we need to reschedule due to weather or unforeseen circumstances, we will notify you as soon as possible.


Property Access

By confirming a delivery or installation, you agree that:

- The delivery area and installation site are clear, accessible, and safe for our vehicle and equipment

- There is adequate space to maneuver and unload plant material safely

- You have the authority to permit work on the property

Black Forest Trees is not responsible for damage to soft ground, narrow access points, unmarked features, or pre-existing property conditions that were not disclosed at the time of booking


Underground Utilities

It is the client's responsibility to ensure that an underground utility locate has been completed through Ontario One Call before any in-ground planting or installation takes place. Call 1-800-400-2255 or visit ontarioonecall.ca — it's free and required by Ontario law. Black Forest Trees assumes no responsibility for damage to underground utilities, irrigation systems, or any buried infrastructure.


Installation Scope

Our installation service includes shallow planting of trees and plants to a maximum depth of approximately 3 feet. We do not use heavy machinery. Installation is limited to the scope described on your invoice. No additional work is included or implied unless agreed upon in writing prior to the job.


Plant Material Condition

All trees and plants are inspected prior to delivery and leave us in good, healthy condition. Once delivered and accepted by the client or a representative on site, responsibility for the plant material transfers to the client. Black Forest Trees does not guarantee plant survival after delivery, as outcomes depend on soil conditions, watering, sunlight, drainage, and ongoing client care.


Damage & Liability

Black Forest Trees takes care when accessing and working on your property. However, we are not liable for:

- Damage to underground infrastructure when a utility locate was not completed by the client

- Damage resulting from pre-existing property conditions not disclosed at time of booking

- Plant failure resulting from client care, soil conditions, or environmental factors after delivery

Our liability for any client-caused outcome is limited to the value of the purchased product.


Acceptance of Delivery

Delivery accepted by the client or a representative on site constitutes full acceptance of the delivered plant material and these terms. Please inspect your order at the time of delivery and raise any concerns before our departure. Any concerns not raised at the time of delivery must be submitted in writing within 14 days of delivery and are subject to the terms of our Refund & Sales Policy.
