Black Forest Trees is a sole proprietor tree and plant delivery and installation business based in Hamilton, Ontario, Canada. We are not a licensed arborist, certified horticulturalist, or registered landscaping professional.
General Guidance Disclaimer
Any tree or plant placement suggestions, care tips, or recommendations provided by Black Forest Trees — whether in person, by phone, text, email, or through our website or Marketplace listing — are offered as general guidance only. They do not constitute professional horticultural, arboricultural, or landscaping advice. The client is solely responsible for verifying that any plant material is suitable for their specific property, soil type, climate zone, and intended use. Black Forest Trees accepts no liability for outcomes resulting from the client's use of any guidance provided.
Research & Information Assistance
As part of our service, Black Forest Trees may voluntarily conduct general research on your behalf, including but not limited to:
- Zoning regulations
- Recommended planting distances
- Species suitability
- Soil preferences
- Seasonal considerations

Limitation of Liability
To the fullest extent permitted by applicable Ontario law, Black Forest Trees shall not be held liable for any indirect, incidental, or consequential damages arising from:
- The client's use of or reliance on any guidance provided
- Client-directed planting or placement decisions
- Plant failure resulting from post-delivery care, soil, weather, or environmental conditions
- Pre-existing property conditions not disclosed at time of booking
Our liability for any client-caused outcome is limited to the dollar value of the purchased product.
Underground Utilities
Clients are responsible for ensuring that a utility locate has been completed through Ontario One Call (1-800-400-2255 / ontarioonecall.ca) before any in-ground installation. Black Forest Trees assumes no liability for damage to underground utilities, irrigation systems, or buried infrastructure of any kind.
Property Access
By booking a delivery or installation, the client confirms that the property is safe and accessible and that they have the authority to permit work on the property. Black Forest Trees is not responsible for damage to soft ground, unmarked features, or pre-existing conditions that were not disclosed at the time of booking.
Living Plant Material
All plants and trees are inspected prior to delivery and sold in good condition. Black Forest Trees does not guarantee plant survival after delivery. All sales on living plant material are final. No refunds will be issued after delivery has been accepted.
Payment Terms
A 50% deposit is required to confirm your order. The remaining balance is due upon delivery. The deposit is non-refundable if the client cancels within 48 hours of the scheduled delivery date. We accept cash and e-transfer only.
Intellectual Property
All content on this website including text, images, logos, and graphics is the property of Black Forest Trees and may not be reproduced or used without written permission.
